TERMS OF AGREEMENT

The conditions of this agreement regulate the service of membership offered by SMSWebAd and stipulated between JSfot and its clients weather private or company.

Art. 1) Services Access - The clients is responsible for any Internet costs. To use our SMSWebAd you need to fill our our registration form, in which you need to give some personal information, and User’s Name and Password, which have to be keep with maximum diligence. The client is also responsible for any damages caused by a third party using the clients User’s Name and Password. The clients will notify SMSWebAd immediately if the password or user’s name was lost, or stolen or misplaced.

Art. 2) Duration - The membership to our services lasts one year, starting from the first membership payment. The services offered (international sms messages) can be used immediately after Digitel Mobile Srl received payment.

Art. 3) Methods of payment - The methods of payment are only those indicated from SMSWebAd: PayPal and postal money order (only Italian residences).

Art. 4) Information - When the contract is all approved within the year SMSWebAd will be sending messages to clients via e-mail to send information and notices of clients membership and other information regarding SMSWebAd services, the client will approve and consent to get these messages and the proper e-mail address.

Art. 5) Recess - The client has a right to cancel proper contract by the immediate communication through registered mail at: JSoft (Via Sant'Anna II Tronco, c/da Falcone, 4 89128 Reggio Calabria - Italy) within 10 days of activation of service or date of payment. In this case SMSWebAd will return proper payment to client. As by the low the client will not be able to use any services once the cancel notice as been received.

Art. 6) Usage of services - The client guarantees that all the material and all messages sent will be proper and the client take back and his/her own virtue any information given by proper identification and or password in good judgment not to hold JSoft responsible or put JSoft in danger with the low. The client also guarantees that all the material does not violate any copyright, with proper license of contract by low and customary. The client also will not use the services offered by SMSWebAd to bother the public to damage, directly or not and to violate any private messages. In particular the client cannot use the technical "spamming" or equal to (sending messages without having the receiver’s authorization). The information send by the client cannot in any form or sense be pornography, obscene or slander. Also it’s forbidden in any case the use of SMSWebAd services to infringe upon directly or indirectly with any lows in any countries. SMSWebAd will close any client’s account if evidences proves them guilty on any violation, according to Article 12.

Art. 7) To cease - It is not possible at any time for a client to either sell at cost or give away his/her contract weather permanent or temporary without consent of SMSWebAd.

Art. 8) Obligations and Prohibition - The client is aware that the SMSWebAd service of sending messages is only active through web site of SMSWebAd. Sms only uses one browser or our software to send messages and only the one browser will be used any other program will be prohibited. In case of mutation on the technical conditions normative and or economical for the supply of service SMSWebAd will have the right to suspend the service giving and three days notice to its clients via their e-mail address SMSWebAd will in that case give back part of the membership that the member put in, minus the messages the client has used at their buying cost.

Art. 9) Missed delivery - The client will realize that sms will not be responsible for any damages caused by a missed delivery or late delivery to a client or between client and third party. SMSWebAd will not guarantee the messages receives responsibility, only the messages that were not sent or received.

Art.10) Improvement - The contract will improve at the time of registration when the client will click on button "Sign Up".

Art.11) Privacy - The client will accept the existence of the server of SMSWebAd in the Log Files that registers all the traffic that happens while browsing in the web site. All the information on the Log File is absolutely private and will only be shown with proper authorization. The client will also realize that SMSWebAd will identify the clients before connecting them to the use of "cookies".

Art.12) Resolution’s - In every case of fulfillment of obligations to the contract, JSoft will resolve the present contract to article 1456 of italian law. In any case JSoft will compensate for the damages occurred. The denial and/or recall of the client treatment of his/her personal information, will give JSoft the possibility to resolve the present contract.  

Art.13) Communication - All the commincations relative to the contract will be send to SMSWebAd E-Mail or a PO Box.  

Art.14) Law Competent - For any controversy the forum is in Reggio Calabria (Italy).
